1Basis of Agreement and Definitions

Any person (“the Client) participating in any services/programs (The Program) offered by IQ Coaching Ltd (Trading as IQTennis or iqtennis.co.ke) shall be taken by such participation to have consented to our policies and Terms and Conditions as set out on this page.

Any reference to “iQTennis” includes its business, directors, employees, consultants, staff and agents. Any reference to “physical activity” or “activity” includes but is not limited to exercise sessions with an IQTennis employee, i.e, a group coaching class, private coaching, cardio tennis, use of facilities and equipment along with any other services provided to the participant by IQTennis.

The Client acknowledges that it is their responsibility to inform their medical advisor of their intention to participate the Programs, and warrants that by their participation that they do so in accordance with the advice of their medical practitioner.

The Client acknowledges that the Program and any exercises carries risks of injury and that they shall not hold IQTennis responsible as a result of any injuries sustained directly or indirectly to themselves or any other person during or after the Program.

The Client acknowledges that they have informed The IQTennis in writing of any condition (medical or otherwise) that would affect their ability to engage in any physical activity or the Program offered by The IQTennis and that they will inform The IQTennis in writing of any changes to their circumstances.

The Client acknowledges that it is their responsibility to inform their medical practitioner prior to engaging in the Program on the premises of IQTennis.

The Client acknowledges that during the conduct of the Program some physical contact may occur between the Client and members of IQTennis and/or other members of the Program and consents to that contact being made.

The Client acknowledges that they are responsible for any damage caused to the facilities or equipment of The IQTennis as a result of their willful act or negligence.

Subject to the law, the Client releases The IQTennis Physio from all losses, claims, costs, liabilities, expenses, suits, damages and action as a result of (but not limited to) the physio undertaking his duties or while assisting the client during an emergency.

iQTennis and its Staff are not responsible for supervising children outside of lesson time.

2Pricing

iQTennis from time to time, may vary its prices to take account of, amongst other things, any change in the cost of providing the goods and services. This will not affect services that have been purchased prior to change.

3Bad Weather Conditions

Our dedication to providing a duty of care to our clients means that sometimes we may have to cancel lessons due to bad weather.

If the courts are unusable due to weather conditions, you will receive a message/email informing you of the same. If you do not receive a message/email, lessons will be conducted at the usual class time. If you have not heard from us please always assume the lesson is on.

4Terms and Conditions
  1. Contract Term:

    The term for a one class booking is 1 class whilst the term for a lesson package is the period the package takes to expire (Between 30 to 90 days depending on the package)
5Cancellation Policy

Cancellation of a booked class must be made 24 Hours in advance of lesson to reschedule.

All cancellations made by the client, with less than 24 hours notice, will be charged as if the lesson took place.
No make-up lessons will be given for late cancellations.

All classes cancelled by iQTennis will be made up at a time mutually agreed between the parties.

Make up lessons will only be given if the participant is unable to attend due to injury or illness (sufficient notice needs to be given), or the lesson is unable to go ahead due to bad weather.

Court Hire Cancellation

Cancellations of court hire must be made 12 hours prior to the start of the session by contacting the venue office. If no one answers please leave a message. Failure to do so will result in a charge for the session. Refund for court hire is not provided, but bookings can be rescheduled to an alternative available day or time by contacting the office.

6Disclaimer

The Client acknowledges that iQTennis reserves the right to cancel, update or vary the Program, including but not limited to, timing, venues, terms, prices, fees, format or instructors in relation to its services without notice at its sole discretion.

The Client acknowledges and accepts all of the conditions contained herein, and forever releases, discharges and indemnifies iQTennis from any loss caused to any party in relation to a claim regarding breach of these Terms and Conditions.

The Client agrees to any official photography, and use of images by iQTennis for professional purposes. Notification must be given in writing if you do not consent to any form of photography.

By joining iQTennis training Program you consent to the collection, storage and use of personal information in accordance with our privacy policy.

That said, iQTennis will only store information relevant for coaching, marketing, promotions and billing purposes. Private information will never be shared with a third party.

7Requirements and recommendations
  1. All players must bring their own racket. If a player has no racket they can hire one from us initially but eventually they’ll have to buy one.
  2. Players must wear adequate apparel for the activity and sport shoes, no jeans, no sandals, or any inappropriate clothes.
  3. Coaches reserve the right of admission if they consider the player is wearing inappropriate shoes or clothes. Dress code will be provided for more details.
  4. Always bring your own water bottle and a towel, food is not permitted inside the courts, take previsions to provide any food or snack prior to the training but consider something light to prevent any nausea, vomiting or stomach hurt during the training.
  5. Any person(s) accompanying the student/player must wait outside of the courts for their safety, this is mandatory, but if for some reason it’s allowed it will be at the person’s own risk.
8Payments and Refund Policy
  • Full payment is required before the start of lessons.
  • Payment is made ONLY to the iQTennis MPESA PAYBILL Number or BANK ACCOUNT and not to the coaches or other staff.
  • We do NOT accept cash payments.
  • NO REFUNDS will be provided under any circumstance. If a player decides for any reason to resign from the tennis program/lesson before the end of their session or package, they forfeit any lessons/time left.
  • A credit may be offered if the client has a valid medical reason which prevents him/her from attending three or more classes in a row. This has to be supported by a signed and stamped medical certificate.

ACCEPTED Methods of Payment

Payments shall only be may be made via Mpesa, Credit card, Paypal or Bank Transfer.

9Player and Parent Code of Conduct
  1. Players must use the correct (clean) language to communicate in the Courts and must be respectful to the other players and the coaches. Disciplinary action will be taken for noncompliance to this policy.
  2. Keep a positive attitude and be open-minded to receiving and applying suggestions and recommendations. Remember the coaches are always looking to help you improve your physical condition and your tennis skills.
  3. All players must arrive on time as class will start as scheduled, unless something occurs out of our control.
  4. Always cooperate with other players and the coaches, including helping to pick up balls and completing training/drills. That will show engagement, responsibility and commitment and these actions will also help to save time.
  5. If you are away for any reason it is essential that you notify absence via call, text message or email in advance. This will entitle you to a make up lesson.

Make up lessons are permitted if ALL the following conditions are met:

  • Absences must be communicated to iQTennis 24 hours prior to the class time
  • The request for a make up lesson must be made in writing.
  • Make up lessons are offered as a courtesy by iQTennis and are subject to availability of coaches and courts.
10Communication Policy

All Communication (for Booking, Cancellation, missed class, rescheduling, payment and others) MUST be done through the OFFICE, MANAGEMENT OR ADMIN via our official communication channels – Our Official Email and Phone Number.

Any such communication done via other parties (including the coaches) shall not be considered.

The coaches deal with matters Tennis, Discipline and Player Development only.

11Disciplinary Actions
  • Coaches have the power and authority to suspend a player whose behavior does not meet the minimum requirements in the court for the rest of the class. Make-up class or Money Refund does not apply.
  • No bad words, fights, racism and judgment of discrimination, indecent behavior, harassment, smoking, among others, are allowed. Players can be suspended for a class or can permanently be withdraw from the academy. Money refund won’t apply.
12General Policies (Class, Conduct and Behavioural)
  1. The last 5mins of every class will be used to collect all the balls and accessories on the court unless the coach indicates otherwise.
  2. iQTennis reserves the right of admission.
  3. The coach has the right to be away from the court for at least 5 minutes, if necessary, to go to the restroom to change his clothes, wash his hands or to cover some basic needs.
  4. If the class is performed on a court where reservation is not allowed, the player(s) must guarantee the court is available at the time the coach arrives on site, otherwise waiting time will be charged at a rate of 50% of the total hourly rate applied per hour, if the class cannot be performed, the full hourly rate shall apply.
  5. Parents or Guardians must pick up the players at the time of dismissal. Coaches and other iQTennis Representatives are not responsible for the players after the session ends. However, we encourage the player to stay close for their safety in case the Parents and/or Guardians are late. Parents/Guardians MUST stay during the session in case of a special needs player or if players are 4 to 8 years old.
  6. Coaches are not allowed to escort players to the restroom. Parents of players 4 to 8 years old must stay behind to assist in such tasks.
  7. Coaches are not fixed to any location, group, or player, all of them will be assigned according to the iQTennis requirement and needs.
  8. For group classes, the coach has the right to cancel the session if there is not enough quorum (2 players minimum), Class will be made-up for the player(s) that shows up for those who did not show up and did not notify their absence in advanced session won’t be made it up.
  9. Pets are not allowed on the courts.
  10. Parents or guardians are not allowed inside the courts for any reason and neither are they allowed to interfere during the training or act like coaches from the outside providing guidance.
  11. Players, parents, or guardians must take their trash and leave the area clean. We appreciate your cooperation and good civic behaviour.
  12. iQTennis is not responsible for any object stolen or damaged in or out of the facility, and that includes the parking lot.
  13. iQTennis is not responsible for any injury, fall or any accident that occurs during the training. If an ambulance is required, we will call it, but we won’t have any payment responsibility.
  14. For players, parents, guardians or relatives, parking rules are mandatory and you must park your car at the designated parking lot in Kenya Science. IQTennis is not responsible for any accident caused within the premises.
